1. Who we are
The HOSSIDARK platform is provided by HOSSIPOWER CONSULTORIA S.A (“HOSSIDARK”, “we”, “us”). By subscribing to or using the platform, a service agreement is entered into between you (or the organisation you represent) and HOSSIPOWER CONSULTORIA S.A.
2. Acceptance
By creating an account, accessing a demonstration environment or continuing to use the platform, you accept these terms. If you use the service on behalf of an organisation, you confirm that you are authorised to bind it; if you use it as an individual, you confirm that you are of legal age.
3. The service
HOSSIDARK is an enterprise platform for security operations (SOC), incident management, document forensics and corporate communications, delivered as an on-premise deployment within the customer's infrastructure and supplied through Hossidark's authorised distribution channel.
4. Accounts and credentials
You are responsible for keeping your access credentials confidential, for all activity carried out under your account and for providing accurate, up-to-date information, including billing and tax identification details.
5. Prohibited use
You must not, among other things:
- use the service for unlawful purposes, fraud, spam or unsolicited communications;
- infringe intellectual property or other third-party rights;
- interfere with the security of the platform, including introducing malicious code, probing, unauthorised penetration testing, bulk data extraction or circumventing technical limits;
- resell, redistribute or reverse engineer the service outside the authorised channel;
- share credentials or exceed the user limits of the licence purchased.
6. Intellectual property
HOSSIPOWER CONSULTORIA S.A retains ownership of the platform, software, documentation, report templates and trademarks. You are granted a limited, non-exclusive, non-transferable right of use within the scope of your licence. The data and content you upload remain yours; you grant us only the licence necessary to host and process them in order to provide the service.
7. Service levels and warranties
We use commercially reasonable efforts to keep the platform available, but we do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we exclude implied warranties of merchantability and fitness for a particular purpose. Detection, correlation and forensic analysis results support human decision-making and do not replace professional judgement.
8. Contracting and payment
The platform is not sold or paid for online. All services are contracted through Hossidark's authorised distributors and resellers, or directly with HOSSIPOWER CONSULTORIA S.A where applicable, on the basis of a written proposal and agreement.
Pricing, billing cycle, applicable taxes, invoicing, renewal and termination are governed by that agreement. Access to the platform and licences are activated by our team once the order has been accepted.
9. Suspension and termination
We may suspend or terminate access in the event of a material breach of these terms, non-payment, security risk or fraud, or repeated or serious breaches of the acceptable use rules. After termination we provide a reasonable period for data export, after which the data is deleted or anonymised.
10. Liability
To the extent permitted by law, our aggregate liability is limited to the fees paid in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or reputation. Liability for wilful misconduct, fraud, death or personal injury is not excluded.
11. Indemnity
You agree to indemnify HOSSIPOWER CONSULTORIA S.A against third-party claims arising from content you upload, unlawful use of the service or breach of these terms.
12. Governing law and assignment
These terms are governed by the law of the jurisdiction in which HOSSIPOWER CONSULTORIA S.A has its registered office, and the courts of that jurisdiction have exclusive competence. You may not assign the agreement without our consent; we may assign it in the event of a restructuring, merger or acquisition. Neither party is liable for failure to perform caused by events beyond its reasonable control.
